Terms & Conditions - Liability Waiver - Privacy Policy

This is the Terms and Conditions Disclosure as well as the Liability Waiver ("Waiver") is entered into on the date of purchased services of the Client, by and between Ur Pooper Scooper ("Company"), and the undersigned client ("Client").

1. General Terms and Conditions of Working with the Business
By engaging the Services of Ur Pooper Scooper, Client agrees to abide by the following general terms and conditions:

Availability and Scheduling: The Company will make reasonable efforts to provide Services as scheduled. However, scheduling may be affected by weather, holidays, or other unforeseen circumstances. If there are any significant changes to the schedule, the Company will notify the Client as soon as possible.

Pets and Safety: Client agrees to secure any pets in a safe area (e.g., inside the house or within a fully secured area) prior to the scheduled visit. The Company is not responsible for pets that are not properly secured or escape during the course of the visit. Any injury to Ur Pooper Scooper staff and/or Contractors caused by Client property/pets will result in charges to the Client.

Service Limitations: While the Company will make every effort to fulfill the requested Services, certain limitations may apply based on factors such as the size of the property, the number or behavior of pets, or accessibility issues. The Company reserves the right to amend or adjust Services as needed. The Company will do their best to discuss additional fees with the Client ahead of time. If that is not possible Client will be responsible for fees. Amended/Adjusted services that require a separate visit to the Client will incur a $20 Inconvenience Fee.

Client Cooperation: Client agrees to provide any necessary instructions, including specific details about the pets or property, and cooperate with the Company to ensure that the Services are carried out smoothly. Client further agrees to provide accurate and up-to-date contact information and access to the property. Information will be initially provided the Client Profile Form. Any new information must be provided in writing via the Client Profile Form or by emailing hello@urpooperscooper.com. Missing and/or incorrect information that results in services not being able to be performed will still result in a full charge of service(s) to the Client.

Independence of Contractors: If subcontractors or independent contractors are used to perform Services, they are acting as independent agents. The Company is not liable for actions or omissions by any such third-party contractors, but will make reasonable efforts to ensure they meet the standards set by the Company.

3. Pricing, Cancellation, Fees and Payment Terms

Pricing
Our goal is to have reasonable and sustainable pricing for our Client. However, prices may vary. Typically pricing is based on clients with 1 pet living within 20 miles of our location in Hoover, Alabama on a 1/4 acre or smaller yard with reasonable terrain. Clients outside of this radius may be asked to pay an Extended Service Area fee of $1.50 per mile outside of our radius per visit or an agreed upon flat fee. Yards larger than 1/4 an acre will be charged a fee of $10 per 1/4 acre over the first 1/4 acre plus the base service fee. Properties with varying terrain/conditions will be priced as agreed upon between the Client and Ur Pooper Scooper.

Cancellations
Non-Member Services: Client agrees to provide a minimum of 48 hours' notice for cancellation of any non-member services. Any cancellations made after this time frame will not be eligible for a refund. The Client acknowledges that the Company may have turned down other services in order to hold the scheduled time for Client.

Membership Cancellation: If the Client wishes to cancel their membership, a notice must be submitted at least 4 weeks prior to the desired termination date. Client understands that they will be charged for an additional 4 weeks of service after the Cancellation Request is received by the Company, regardless of the desired cancellation date. If a Client would like to skip a service rotation they will still be charged as stated by their membership.

Cancellation and Refund Requests: All cancellation and refund requests must be submitted in writing to hello@urpooperscooper.com.

Late Payment Fee: If payment for Services is not processed prior to the scheduled service date, a late fee of 30% of the total amount due for that service will be applied.

Additional Late Fees: If payment is not received within 3 business days after the service date, an additional late fee of 10% of the outstanding balance will be charged.

Collections: Payments that remain unpaid for more than 30 days will be forwarded to a collection agency for non-payment, and Client will be responsible for any costs associated with the collection process, including legal fees and other associated charges.

4. Chargebacks
Client agrees not to initiate a chargeback for any payments made to the Company. If Client has concerns or questions regarding any payment, they are required to submit such inquiries in writing to hello@urpooperscooper.com. Client agrees to allow 72 business hours for the Company’s team to respond to and resolve any concerns or disputes regarding payments. Initiating a chargeback without prior communication with the Company may result in additional 50% fee of amount charged and suspension of Services until the issue is resolved.

5. Use of Contact Information
Client agrees to allow the Company to contact them via the contact information they have provided, including phone, email, and/or SMS. This communication may include, but is not limited to, service reminders, updates, billing inquiries, sales events/promotions, and other essential communications related to the Services. Client agrees to pay for any costs associated with communication through these mediums, including any applicable charges from their phone carrier or email service. The Company will not be held responsible for any costs incurred by Client in relation to such communication. Client may submit any changes to their preferred communication methods in writing to hello@urpooperscooper.com.. The Company will make reasonable efforts to accommodate these preferences where possible.

Privacy and Data Protection: The Company respects Client privacy and will only collect, use, and store personal information necessary for the provision of Services. The Company will not share Client information with third parties without Client consent, unless required by law.

6. Governing Law
This Waiver shall be governed by and construed in accordance with the laws of the state of Alabama, without regard to its conflicts of law principles.

7. Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to this Waiver, the Services, or any other aspect of the relationship between the Company and Client shall be resolved by binding arbitration. The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA), and the arbitration shall take place in Jefferson or Shelby County, Alabama. The decision of the arbitrator shall be final and binding on both parties, and judgment on the award may be entered in any court having jurisdiction thereof. Client acknowledges that by agreeing to this arbitration clause, they are waiving their right to a jury trial or to participate in a class action lawsuit.

8. Acknowledgement of Risk
Client acknowledges and understands that pet waste removal and walking services ("Services") involve potential risks, including but not limited to injury, property damage, or zoonotic diseases that may arise during the course of these services. Client agrees to assume all such risks and agrees that the Company will not be held liable for any injury, loss, or damage to Client, their pets, or their property arising from or related to the Services, including, but not limited to, accidents, bites, or illness.

9. Health of Pets
Client certifies that their pets are in good health and free from contagious diseases. Client agrees to notify the Company of any known medical conditions, aggressive behavior, or special needs of their pets before the provision of services. The Company reserves the right to refuse services if a pet is deemed unsafe or presents a risk to the safety or well-being of the pet, the walker, or others.

10. Property Damage
Client understands and agrees that the Company is not responsible for any damage to Client’s property during the provision of Services, including but not limited to damage to gates, fences, furniture, or other personal property. While every effort will be made to avoid such damage, Client agrees to hold the Company harmless for any such incidents. If the Client has any concerns about damage, submit your concern with supporting documents/photos to hello@urpooperscooper.com.

11. Indemnity
Client agrees to indemnify, defend, and hold harmless the Company, its employees, agents, and subcontractors from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of, or in connection with, the provision of Services or any activities related thereto.

12. Emergency Care
In the event of an emergency involving Client's pet(s), the Company will attempt to contact the Client or their emergency contact. If the Company is unable to reach the Client, the Company is authorized to seek veterinary care for the pet(s) at the Client's expense. Client agrees to pay for any veterinary services rendered in such an emergency.

13. Right to Refuse Service
The Company reserves the right to refuse or discontinue Services at any time if the Client’s pet(s) exhibit dangerous, aggressive, or uncontrollable behavior or if the Client fails to provide necessary information regarding the pet(s) or property that could affect the safety and well-being of the walker or the pet(s) and/or the cost of the services requested.

14. Entire Agreement
This Waiver constitutes the entire agreement between the Company and the Client with respect to the subject matter hereof and supersedes all prior understandings, agreements, or representations regarding the Services. By signing below, the Client acknowledges that they have read, understand, and agree to the terms and conditions of these Terms and Conditions and Liability Waiver. Client further acknowledges that they are voluntarily waiving certain legal rights, including the right to a jury trial, and agree to resolve any disputes through arbitration.

15. Required Disclosures for Direct Consumer Business
Business Name and Address: The Company’s official name is Ur Pooper Scooper, and its principal business address is 1884 Cyrus Cove Terrace Hoover, AL 35244. The Company may be contacted by email at hello@urpooperscooper.com. or by phone at 659-207-920.

Payment Processing: Client authorizes the Company to process payments for services rendered in accordance with the terms of this agreement. Payments are due prior to or on the scheduled date of service. Failure to make timely payments may result in late fees as described above.

Consumer Rights and Cancellation: As required by applicable law, Clients have the right to cancel services within a specified period as outlined in this agreement. Refunds for services will be processed in accordance with the Company's cancellation and refund policies.
